Are You Afraid of FIPPA?

For Healthcare organizations in Ontario, a big deadline looms: as of January 1, 2012, the Freedom of Information and Protection of Privacy Act (FIPPA) will apply to hospitals.

Perhaps the scariest thing about FIPPA is the wide scope that it covers. To make it less scary, let’s examine how FIPPA applies to email.

FIPPA is intended to solve two issues protection of privacy and access to information. Accordingly, the act requires that hospitals using email must:

(1)    …safeguard confidential information that is sent by email. For instance, confidential patient records must be transmitted using methods that ensure privacy.

(2)    …make email records accessible in the event of a FIPPA-sanctioned Open Records request.

Designing an email policy is critical in becoming FIPPA compliant. Policy-based software is the next step; proper software ensures that policies are being followed by end users and assists in the event of a FIPPA request for information. Proper software can also defend against FIPPA sanctions by demonstrating how the hospital has indeed adopted and enforced a FIPPA policy.
